These terms govern use of the iPhone app Gildam (the “App”) provided by JP LAB (제이피랩, “we”). By downloading or using the App, you agree to these terms and the Gildam privacy policy.
Please note
- Gildam does not replace a dedicated dashcam or safety device, and recording is not guaranteed.
- Do not operate the App while driving. Safe driving is the driver's responsibility.
- You are responsible for how you use and share what you record.
1. Purpose
These terms set out the rights, obligations, and responsibilities between us and App users, and the conditions of use.
2. Apple's standard terms
- The App is distributed through the Apple App Store and TestFlight. Apple's Standard End User License Agreement and these terms both apply. Where they differ, the provision more favorable to you applies.
- We, not Apple, are responsible for the App and its support. Apple is not a party to these terms and has no obligation to maintain or support the App.
- Purchases, payments, and refunds follow Apple's policies. Version 1.1 is free.
3. What the App does
The App records drives while it stays on screen on an iPhone mounted in a car, lets you review marked moments and location records on a map with the video, and lets you save ranges to Photos or share them. It does not provide background recording, automatic collision detection, parking mode, automatic plate recognition, or direct submission to authorities.
4. License
- We grant you a non-exclusive, non-transferable right to use the App for personal, non-commercial purposes on Apple devices you own or control.
- You may not reverse engineer, modify, or redistribute the App or bypass its security, except as the law allows.
- We own the App, its design, and trademarks. You own the videos and records you make with it.
5. Safe use
- Before driving, mount the device securely where it does not block your view, and start recording and finish settings.
- Do not look at or operate the App while driving; add marks only when stopped or with a passenger. Follow traffic laws.
- Long recording, direct sunlight, and charging can heat the device or stop recording. Check your device and use it safely.
6. Your responsibility for recordings
- Use what you record lawfully. Tell passengers about audio recording, and never record in breach of Korea's Protection of Communications Secrets Act or similar laws.
- Faces, license plates, and locations in videos may be protected personal information or portrait rights. You are responsible when you share, post, or submit videos.
- You decide whether and what to submit to police, insurers, or reporting services. We do not guarantee that videos are admissible or have any legal effect.
7. Disclaimer
- Recording may stop or miss scenes depending on device performance, storage, heat, battery, iOS permissions, other apps or calls, and mounting. We do not guarantee recording of any scene, image quality, night legibility, or location accuracy.
- We do not warrant that the App fits a particular purpose or is error free, to the extent permitted by law.
8. Limitation of liability
- For this free App, we are not liable for losses from failed recordings, lost videos, device damage, or traffic accidents, unless caused by our intent or gross negligence.
- You are responsible for losses and third-party disputes caused by your breach of these terms or the law.
- This section applies only to the extent permitted by law, including the Korean Act on the Regulation of Terms and Conditions, and does not limit liability that cannot be excluded by law.
9. Data and backups
Videos and records are stored on your device; we do not keep them. Deleting the App or resetting the device deletes them and we cannot recover them. Save important videos to Photos.
10. Changes to or end of the App
We may add or change features through updates or stop providing the App when necessary, announcing important changes in advance through the App or the Website. Videos already on your device remain yours.
11. Changes to these terms
We may change these terms within the limits of the law, announcing them on this page 7 days in advance (30 days for changes unfavorable to you). Continuing to use the App after the change means you accept it.
12. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Korea. Disputes are resolved in the court with jurisdiction under the Korean Civil Procedure Act.
